The judge overseeing Caldera's antitrust lawsuit against Microsoft (not be confused with the larger antitrust case filed by the U.S. government) ruled against the software giant Wednesday, when it tried to have some of the claims against it thrown out. Microsoft had asked the judge to not consider possible violations outside of the United States, but Judge Benson ruled otherwise.
This latest blow is only one in many small defeats Microsoft has suffered in Benson's court. Last week, Benson ruled against four of Microsoft's motions, which attempted to dilute the case against it. Caldera, which inherited the case from Digital Research when it bought the company, is suing Microsoft for unfairly killing the market for its DR-DOS operating system.
The Caldera lawsuit is expected to go to trial in January
