The U.S. Department of Justice (DOJ) on Friday said that Microsoft's request to have Windows 98 excluded from the temporary injunction against the company should be denied by the Court of Appeals. Citing procedural errors by the Redmond software giant, the DOJ said Microsoft should have asked the district court for a "further order" rather than go directly to the appeals court. Furthermore, the DOJ said, Microsoft had six months to ask that Windows 98 be exempted but instead waited until the last minute. Microsoft is due to ship Windows 98 to hardware manufacturers next week
